About Probate Lawyers
Do you actually know how a probate court works? The whole court thing may not work as you think. That is why people need probate lawyers to help them with their cases. If you find yourself in need of one, then do you know where to go to find one? Do you use the same one your family has always used? Maybe this article can be of some help to you in case you ever find yourself in this delicate situation where an estate is being contested.
Before you begin your search for a lawyer, you need to know how the probate process works. Once a person dies, his or her estate automatically enters the probate system. Most people do not realize this but it is a fact. It is not a bad thing. This is when the will is read and the estate is divided and distributed. It should be simple, right? Well, unfortunately this is where many fights begin. Many times there is no will left or the will is very old and has not been updated, so someone close to the deceased challenges the will. At this point it has to enter into the judicial system.
Probate lawyers will defend whatever side their client is on. It is their job. If you believe that you are entitled to a vast majority of the property and feel like you can prove it, then your attorney will work with you to win you the case. It is the job of the probate judge to determine whether or not that is the actual truth. When you go looking for a lawyer, you might want to select someone who knows you already, like a family attorney who is already familiar with the will.
Here is the bad news when it comes to attorneys and using the “family” lawyer. Suppose you and your sibling are in a dispute over your deceased father’s estate. Perhaps you feel that you are entitled to more because you took care of him in his final years. Whatever the reason, the problem can arise when both of you want to use the same lawyer because he or she is the family lawyer.
Not everyone will need to know, or ever use probate lawyers in their lifetime. That is a great thing because it means that they will never be involved in a dispute over the earthly possessions of a dearly departed family member. But if you ever find yourself in that particular situation, then at least you will know where to turn for advice on your particular case. Make it your goal to find an attorney this year and develop a good working relationship with him or her.
